Functions
Import/Export The Commission must be consulted before any electricity exportation excepted in 2 cases:
  • If the production is dedicated to the exportation
  • In the case of interconnections
Generation/Production
  • Studies applications and delivers permits for the realisation and operation of new power plants
  • Resorts to the tender procedure for the construction of new power plants in case of an insufficient number of applications for permits and takes the necessary measures to meet the needs of the national market
  • Establishes and submits, each two years, to the approval of the Ministry in charge of energy an indicative program of power plants needs over the ten next years
Wholesale/Trading
  • The management of the electric power market is insured by a single operator called market operator through a commercial enterprise whose function is the management of the electric power sales and purchasing offer system
  • The market operator is created in accordance with the provisions of articles 172 and 173 of the law 02-01. No shareholder may own a direct or an indirect share exceeding ten per cent (10%) of the capital of the market operator's enterprise
Balancing
  • Approves beforehand the functioning rules and procedures of the system operator, the market operator and the gas transmission network manager
  • Promotes favourable rules that incite the emergence of these markets
Transmission
  • Delivers permits for transmission electricity and gas network activities
  • Approves development plans of electricity and gas transmission networks submitted by the concerned operators
  • Terms of the third party access to the networks, a fundamental principle towards an open market for electricity and gas, are defined in the legal framework and will be completed by legal ways
  • Defines the transmission tariffs according to a methodology which is fixed by a legal text
  • Controls the respect the free access to the grid
  • Takes all initiatives regarding supervision and organisation of the electricity and national gas network markets
  • Promotes favourable rules that incite the emergence of these markets
  • TPA terms are defined by a governmental decree
Distribution
  • Resorts to the tender procedure and studies applications of granting the concession of electricity and gas distribution
  • Takes all initiatives regarding supervision and organisation of the electricity and national gas network markets
  • Determinates the tariffs for the use of networks
Supply
  • Establishes and submits, every year, to the approval of the Ministry in charge of energy an indicative supply programme of the national gas market over the ten next years
  • Determines and tariffs to apply to the non eligible clients
Cross-sectoral
  • Determines remuneration of the operators in the sector
  • Insures the management of the electricity and gas fund for the perequation of tariffs and costs relative to the transition period to a competitive system
  • Proposes general and specific standards as to the quality of the supply and the customer's service as well as the control measures
  • Publishes useful information for the defence of consumer's interests
Monitoring powers
  • Controls the implementation of technical regulations, hygiene, security and environment protection conditions
  • Controls and assesses the public service obligations
Settlement powers The law also predicts within the regulation commission:
  • A conciliation department for conflicts resulting from the implementation of the regulations particularly those relative to access to networks, tariffs and remuneration of operators
  • An arbitration chamber, on request from the parties, rules on conflicts which may arise among operators except for those related to contractual rights and obligations
Enforcement powers
  • Determines administrative sanctions against the non-respect of consumer protection rules and standards as well as the indemnities to be paid to consumers
  • Attends to ensure a free and non discriminatory access to networks
  • CREG can revises tariffs and suspend or revoke licences
Financing Financial autonomy (Financing by a contribution from the tariffs)and budget approved by the Ministry of Energy and Mines.
